Consumer Rain Check Laws In Wisconsin

According to The 'Lectric Law Library, a rain check can be requested if a store advertises a product it fails to carry in large enough quantities to meet adequate demand.

The Wisconsin Department of Agriculture, Trade and Consumer Protection reports rain checks are covered under the state's deceptive advertising law. This law forbids statements that are untrue, deceptive and misleading in all forms of media and oral statements.


Stock


When a business offers goods or services at a discount, Wisconsin law requires them to carry enough stock to meet demand, unless they state "numbers are limited" in their promotional materials. Rain checks allow a consumer in Wisconsin to purchase the product at the reduced price after the sale ends when the item returns to stock.


Complaints


Under Wisconsin law, consumers who feel they have been misled by advertising or refused rain checks can file complaints with the Wisconsin Division of Consumer Protection. According to the Wisconsin Department of Agriculture, Trade and Consumer Protection, the Division of Consumer Protection can pursue court action against a business to obtain damages for consumers.
